Recently, the short-time working allowance, which many sectors have had to resort to in order to heal the wounds caused by globalization, global health issues, and the resulting economic crises, has been regulated with the aim of being beneficial especially to firms that are economically weak.<\/p>\n<p>Employers, during periods when they partially or completely do not need labor due to an economic crisis or force majeure, often see avoiding wage payments as a solution. Indeed, the COVID-19 pandemic, declared by the World Health Organization and affecting both our country and the entire world, has drastically reduced the labor needs of employers, except in certain sectors. As a result, employers initially resort to downsizing, and the termination of employees' contracts often comes up first. However, this situation could increase unemployment rates nationwide in the long term and cause significant damage to the country's economic structure. Therefore, employers who do not want to lay off workers prefer to reduce working hours and cut production during this period, aiming to both reduce their inventories and lower wage payments, thus reducing workplace expenses. Consequently, while short-time working allowances may initially seem to benefit the employer, they are a regulation made to ensure that employees are not harmed as a general rule.<\/p>\n<p>In order to minimize the economic and social damage caused by the pandemic in our country, employers have been encouraged to apply for short-time working allowances, and the conditions for benefiting from the allowance have been simplified due to the existence of force majeure circumstances. In this context, for employers to benefit from the short-time working allowance, the employer must prove that, due to general economic, sectoral, regional crises, or force majeure reasons, the working hours at the workplace have significantly decreased or ceased. This must be confirmed through the ministry's circulars that cover the company's area of activity or by demonstrating that, due to general force majeure reasons, the company has reduced or halted operations based on a management decision.<\/p>\n<p>The conditions for employees to benefit from the short-time working allowance are as follows:<\/p>\n<ul>\n<li>The employer's request for short-time working must be approved as a result of an inspection by labor inspectors.<\/li>\n<li>The employee subject to short-time working must have fulfilled the working hours and premium payment conditions on the date when the short-time working starts (in the case of short-time working applications due to the effects of Covid-19, the employee must have paid premiums for 450 days within the last 3 years, provided that they are subject to an employment contract within the last 60 days).<\/li>\n<li>The employee's information must be included in the list of individuals participating in short-time working, as a result of the inspection conducted by labor inspectors.<\/li>\n<\/ul>\n<p>As can be seen, the conditions for receiving short-time work allowance have been eased by reducing the requirement of being under an employment contract for the last 120 days to 60 days, and the condition of having paid 600 days of premiums in the last 3 years to 450 days, thus opening the way for more businesses and employees to benefit. The amount to be paid under the short-time work allowance is 60% of the daily average gross earnings calculated based on the insured person's premium-based earnings over the last twelve months. The amount calculated in this way cannot exceed 150% of the gross amount of the monthly minimum wage.
